Terms of Service
Last updated: 1 July 2026 · These terms are governed by the laws of the Republic of Namibia.
These Terms of Service ("Terms") form a binding agreement between you ("Client", "you") and AMATETA Technology & Graphics CC, trading as AMATETA Hosting, of Bismark Street 36, Windhoek West, Windhoek, Namibia ("AMATETA", "we", "us"). By creating an account or ordering any service you accept these Terms in full.
1. Services
We provide web hosting, domain registration and management, SSL certificates, email hosting and related services as described on our website. Service specifications (storage, bandwidth, mailboxes) are those published on the relevant product page at the time of order.
2. Accounts
- You must provide accurate, current contact information and keep it updated. Notices sent to your registered email address are deemed received.
- You are responsible for all activity under your account and for keeping your password and two-factor credentials secure.
- Accounts may not be created by persons under 18 without a guardian's consent.
3. Fees, billing and VAT
- All prices are quoted in Namibian Dollars (N$) and exclude 15% VAT unless stated otherwise. VAT is itemised on every invoice.
- Renewal invoices are issued 14 days before the due date. Payment reminders are sent at 7, 3 and 1 day(s) before due.
- Services unpaid 3 days after the due date are suspended automatically. Services unpaid 30 days after the due date are terminated and data may be permanently deleted.
- Prices may change with 30 days' notice; changes take effect at your next renewal.
4. Refunds
- Shared, WordPress and reseller hosting carry a 30-day money-back guarantee on first orders.
- Domain registrations, renewals and transfers are non-refundable — registries charge us irreversibly on submission.
- SSL certificates are refundable within 7 days if not yet issued.
- VPS and dedicated servers are refundable on a prorated basis only where we fail to meet the SLA.
5. Acceptable use
You may not use our services to host, transmit or link to:
- content that is unlawful in Namibia or the hosting jurisdiction, including child sexual abuse material, incitement to violence, or infringement of intellectual property;
- malware, phishing pages, botnet controllers or exploit tools;
- unsolicited bulk email (spam) — all outbound mail is rate-limited and monitored;
- cryptocurrency mining or other workloads that abuse shared resources;
- content that materially degrades service for other clients (fair-use applies to "unlimited" features).
We may suspend a service immediately and without notice where continued operation poses a legal, security or network risk. Abuse reports: hosting@amateta.com.
6. Domains
- Domain registrations are subject to the registry's own policies (ICANN and the relevant registry for each extension).
- You are responsible for renewing domains on time. Expired domains may enter redemption, incur registry recovery fees, or be released publicly.
- We will release EPP/authorisation codes to the verified account holder on request; we never hold domains hostage.
7. Backups and data
We run automatic backups as described per plan, but backups are a courtesy, not a guarantee. You remain responsible for keeping your own off-site copies of critical data. Following termination, data is queued for deletion and cannot be guaranteed recoverable.
8. Service levels
Uptime commitments and remedies are set out in our Service Level Agreement, which forms part of these Terms.
9. Limitation of liability
To the maximum extent permitted by Namibian law, our total liability for any claim arising from the services is limited to the fees you paid us for the affected service in the 3 months preceding the event. We are not liable for indirect or consequential loss, including lost profits, lost data or reputational harm.
10. Termination
You may cancel any service from your client area (immediate or end-of-term). We may terminate with 30 days' notice for convenience, or immediately for material breach of these Terms. Sections that by nature survive termination (fees owed, liability, governing law) survive.
11. Changes to these Terms
We may update these Terms by publishing the revised version on this page and emailing registered clients at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
12. Governing law & disputes
These Terms are governed by the laws of the Republic of Namibia. Disputes are subject to the jurisdiction of the Namibian courts, sitting in Windhoek.
